These Terms of Service ("Terms") govern your use of the Murmur mobile application (the "App") operated by 1532863 B.C. Ltd. ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.
Acceptance of Terms
By accessing or using Murmur, you confirm that:
You are at least 13 years old (or the age of majority in your jurisdiction)
You have the legal capacity to enter into these Terms
You will comply with all applicable laws and regulations when using the App
If you are under 18, you must have permission from a parent or guardian to use the App.
License to Use the App
2.1 Grant of License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal iOS device for personal, non-commercial use, subject to these Terms.
2.2 Restrictions
You may NOT:
Copy, modify, distribute, sell, or lease any part of the App
Reverse engineer, decompile, or disassemble the App
Use the App for any illegal or unauthorized purpose
Attempt to access or interfere with the App's servers or networks
Use the App to harass, abuse, or harm others
Upload malicious code, viruses, or harmful content
Use automated tools (bots, scrapers) to access the App
Resell, sublicense, or redistribute access to the App
Subscriptions and Payments
3.1 Subscription Plans
Murmur offers the following subscription options:
Weekly Subscription: Auto-renews every week
Monthly Subscription: Auto-renews every month
Annual Subscription: Auto-renews every year
Pricing is displayed in the App and may vary by region. All prices are in your local currency and include applicable taxes.
3.2 Free Trial
We may offer a 7-day free trial for new users. You will not be charged until the trial period ends. If you do not cancel before the trial ends, your subscription will automatically begin, and you will be charged.
3.3 Payment and Billing
Payments are processed through Apple's App Store (In-App Purchase)
Payment will be charged to your Apple ID account at confirmation of purchase
Subscriptions automatically renew unless you cancel at least 24 hours before the current period ends
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage your subscription and turn off auto-renewal in your Apple ID Account Settings
3.4 Cancellation and Refunds
You may cancel your subscription at any time from your Apple ID Account Settings
Cancellation takes effect at the end of your current billing period
No refunds for partial subscription periods
Refund requests must be made through Apple, as all payments are processed by Apple's App Store
We do not have access to Apple's refund policies or decisions
3.5 Price Changes
We reserve the right to change subscription prices at any time. Price changes will:
Apply to new subscribers immediately
Apply to existing subscribers upon their next renewal period
Be communicated to you in advance via email or in-app notification
User Content and Data
4.1 Your Data
You retain all ownership rights to the content you create in Murmur, including:
Voice recordings
Journal entries and reflections
Tasks and notes
Photos and attachments
4.2 Data Processing
By using the App, you grant us permission to:
Process your voice recordings through OpenAI Whisper API for transcription
Process transcripts through Anthropic Claude AI for generating reflections and tasks
Store your journal data locally on your device
Sync your data to iCloud (if you enable this feature)
See our Privacy policy below for details on how we handle your data
4.3 Prohibited Content
You may not use the App to create, store, or share content that:
Is illegal, harmful, threatening, abusive, or defamatory
Infringes on intellectual property rights
Contains viruses or malicious code
Violates the privacy or rights of others
While your journal is private, we reserve the right to investigate and take action if we become aware of prohibited content.
Intellectual Property
5.1 Our Ownership
All rights, title, and interest in the App, including:
Software code, design, and functionality
Murmur name, logo, and branding
Documentation and user interface
...are owned by 1532863 B.C. Ltd. and protected by copyright, trademark, and other intellectual property laws.
5.2 Your Ownership
You retain all rights to the content you create using the App. We do not claim ownership of your journal entries, voice recordings, or other personal content.
Third-Party Services
The App integrates with third-party services (OpenAI, Anthropic, Supabase, Apple iCloud) to provide AI features and data syncing. Your use of these services is subject to their respective terms and privacy policies:

Disclaimers and Limitation of Liability
7.1 App Provided "As Is"
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
Warranties of merchantability or fitness for a particular purpose
Warranties that the App will be uninterrupted, secure, or error-free
Warranties regarding the accuracy or reliability of AI-generated content
7.2 No Medical or Professional Advice
Murmur is a journaling and productivity tool, not a substitute for professional medical, psychological, or therapeutic advice. The AI-generated reflections are for informational purposes only and should not be relied upon for:
Mental health diagnosis or treatment
Medical advice
Legal, financial, or professional counseling
If you are experiencing a mental health crisis, please contact a qualified healthcare provider or crisis hotline immediately.
7.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 1532863 B.C. LTD. SHALL NOT BE LIABLE FOR ANY:
Indirect, incidental, special, consequential, or punitive damages
Loss of data, profits, revenue, or business opportunities
Damages arising from your use or inability to use the App
Damages caused by third-party services (OpenAI, Anthropic, etc.)
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above may not apply to you in full.
Indemnification
You agree to indemnify, defend, and hold harmless 1532863 B.C. Ltd., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
Your violation of these Terms
Your use or misuse of the App
Your violation of any third-party rights
Content you create or upload to the App
Privacy
Your privacy is important to us. Please review our Privacy Policy Below to understand how we collect, use, and protect your personal information.
By using the App, you consent to our Privacy Policy.
Termination
10.1 Your Right to Terminate
You may stop using the App at any time. To terminate your account:
Delete the App from your device
Cancel your subscription through Apple ID Account Settings
10.2 Our Right to Terminate
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if:
You violate these Terms
Your use of the App poses a security or legal risk
We discontinue the App or service
Upon termination:
Your license to use the App will end immediately
You will lose access to the App and any subscription benefits
Your local data will remain on your device until you delete the App
Changes to These Terms
We may update these Terms from time to time. When we make changes:
We will update the "Last Updated" date at the top of this document
For material changes, we will notify you via email or in-app notification
Continued use of the App after changes constitutes acceptance of the new Terms
If you do not agree to the updated Terms, you must stop using the App and cancel your subscription.
Governing Law and Dispute Resolution
12.1 Governing Law
These Terms are governed by and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of law principles.
12.2 Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through:
Informal negotiation: Contact us at admin@tensai.tech to attempt resolution
Binding arbitration: If negotiation fails, disputes shall be resolved through binding arbitration in British Columbia, Canada, in accordance with the rules of the British Columbia International Commercial Arbitration Centre (BCICAC)
Small claims court: You may bring claims in small claims court if they qualify
12.3 Class Action Waiver
You agree to resolve disputes with us on an individual basis only. You waive any right to bring claims as part of a class action, collective action, or representative proceeding.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and 1532863 B.C. Ltd. regarding your use of the App and supersede any prior agreements.

Apple-Specific Terms
16.1 Acknowledgment
You acknowledge that these Terms are between you and 1532863 B.C. Ltd., not Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
16.2 Scope of License
Your license to use the App is limited to a non-transferable license to use the App on an Apple-branded device that you own or control, as permitted by Apple's App Store Terms of Service.
16.3 Maintenance and Support
1532863 B.C. Ltd. is solely responsible for providing maintenance and support for the App. Apple has no obligation to provide support.
16.4 Warranty
To the extent permitted by law, Apple provides no warranty for the App. Any claims, losses, or damages arising from the App are the sole responsibility of 1532863 B.C. Ltd., not Apple.
16.5 Product Claims
1532863 B.C. Ltd., not Apple, is responsible for addressing any claims relating to the App, including:
Product liability claims
Claims that the App fails to conform to legal requirements
Claims arising under consumer protection laws
16.6 Intellectual Property
In the event of a third-party claim that the App infringes intellectual property rights, 1532863 B.C. Ltd., not Apple, will be responsible for investigation and defense.
16.7 Third-Party Beneficiary
Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

We automatically collect:
- Device information (iOS version, device model) for compatibility purposes
- App usage data (session timestamps, feature usage) to improve the App
- Error logs and crash reports to diagnose and fix technical issues
1.3 Information We Do NOT Collect
- We do not collect your name, email address, or contact information (unless you
contact us for support)
- We do not track your location
- We do not collect identifiable information about you beyond what's necessary to
operate the App

2. How We Use Your Information
We use your information to:
- Transcribe voice recordings using OpenAI's Whisper API
- Generate AI reflections and insights using Anthropic's Claude AI
- Extract tasks from your morning check-ins automatically
- Store your journal entries locally on your device
- Sync your data via optional cloud backup (if you enable it in Settings)
- Improve the App by analyzing usage patterns and fixing bugs
- Provide customer support when you contact us

3. Data Storage and Security
3.1 Local Storage
- All your journal data is stored locally on your iPhone or iPad using Apple's
SwiftData framework
- Your voice recordings, transcripts, reflections, tasks, photos, and mood entries
remain on your device except:
- Temporarily during AI processing (see section 3.2)
- When syncing to cloud backup (if you enable it)
3.2 Third-Party AI Processing - What Data is Sent and Where
IMPORTANT: Murmur uses third-party AI services to provide voice transcription and AI
reflections. Before using these features, you will be asked to consent to sending
your data to these services.
When You Use Voice Recording:
1. Your voice recording is sent to our secure Supabase Edge Functions
2. Our Edge Functions forward the audio to OpenAI's Whisper API (a third-party AI
service) for speech-to-text transcription
3. Voice recordings are deleted immediately after transcription (within seconds)
4. OpenAI does not store your audio or use it to train their AI models
When You Use AI Reflections:
1. Your journal transcript (the text of what you said/wrote) is sent to Anthropic's
Claude AI (a third-party AI service)
2. Additional context sent to Claude includes:
- Your mood selection
- Your task list
- Previous conversation context (for follow-up questions)
3. Claude processes this data in real-time to generate personalized reflections and
insights
4. Transcripts and conversation data are processed in real-time and not stored on
Anthropic's servers or used to train their AI models
5. Only the final AI-generated reflections are returned to your device
Data Flow Summary:
- OpenAI (Whisper) receives: Voice audio only
- Anthropic (Claude) receives: Journal text, mood, tasks, and conversation context
- We do not store your voice recordings or transcripts on our servers
- Third parties do not use your data to train their AI models
3.3 Cloud Backup (Optional)
- If you enable Cloud Backup in the App's Settings, your journal data will sync to
secure cloud storage (Supabase)
- This includes: journal entries, tasks, photos, mood selections, and AI conversation
history
- Your data is encrypted during transmission using HTTPS
- You can disable cloud backup and delete all cloud data at any time in Settings
3.4 Data Security
- All data transmitted to/from AI services uses HTTPS encryption
- Voice recordings are processed through Supabase Edge Functions with
industry-standard security
- Your journal entries are stored using Apple's secure SwiftData framework on your
device
- We implement reasonable security measures to protect your data from unauthorized
access

4. Third-Party Services
We use the following third-party services to operate the App. You will be asked to
consent to sharing your data with these AI services before using voice or reflection
features.
4.1 OpenAI (Whisper API)
- Purpose: Transcribe voice recordings to text
- Data Shared: Voice recordings only (audio files)
- Data Retention: Audio is deleted immediately after transcription (within seconds)
- Training: OpenAI does not use your audio data to train their AI models

4.2 Anthropic (Claude AI)
- Purpose: Generate AI reflections, extract tasks from journal entries, and answer
follow-up questions
- Data Shared:
- Journal transcripts (text of your entries)
- Mood selections
- Task lists
- Conversation history (for context in follow-up questions)
- Data Retention: Data is processed in real-time and not stored on Anthropic's
servers
- Training: Anthropic does not use your data to train their AI models

4.3 Supabase (Cloud Infrastructure & Edge Functions)
- Purpose:
- Securely route API requests to OpenAI and Anthropic
- Store encrypted cloud backups (if you enable Cloud Backup)
- Data Shared:
- Voice recordings and transcripts (temporarily during processing only)
- All journal data (if you enable Cloud Backup)

4.4 RevenueCat (Subscription Management)
- Purpose: Manage in-app subscriptions and purchases
- Data Shared: Anonymous subscription status, purchase receipts (no personal journal
data)

5. Your Consent and Control
5.1 AI Data Sharing Consent
Before you can use voice recording or AI reflection features, you will see a consent
screen explaining:
- What data will be sent to third-party AI services
- Who the data will be sent to (OpenAI and Anthropic)
- How the data will be used
- That the data is not used to train AI models
You must explicitly consent by tapping "I Agree" before the app will send any data to
these third-party AI services.
5.2 Withdrawing Consent
If you wish to stop sharing data with third-party AI services, you can:
- Stop using voice recording and AI reflection features
- Contact us at admin@tensai.tech to delete your account and all associated data
Note: The core AI features of Murmur require processing by these third-party services
to function.

6. Data Retention and Deletion
6.1 How Long We Keep Your Data
- Journal entries, tasks, photos: Stored locally on your device until you delete them
- Cloud backups: Stored until you delete them or disable cloud backup
- Voice recordings: Deleted immediately after transcription (within seconds)
- Transcripts sent to AI services: Not stored; processed in real-time and discarded
- Error logs: Retained for up to 30 days for debugging purposes
6.2 How to Delete Your Data
You can delete your data at any time:
1. Delete individual entries: Swipe to delete entries in the Calendar view
2. Delete all local data: Go to Settings → Data & About → "Clear All Data" to
permanently delete all journal entries, tasks, and settings from your device
3. Delete cloud data: Go to Settings → Cloud Backup → "Delete All Cloud Data" to
permanently remove all synced data from our servers
Once deleted, your data cannot be recovered.

7.3 CCPA Rights (California Users)
If you are a California resident, you have rights under CCPA:
- Right to know what personal information we collect
- Right to delete your personal information
- Right to opt-out of sale of personal information (Note: We do NOT sell your data)
